Advertising mails (Spam) – Cold Call:
We would like to point out that the sending of electronic direct advertising or advertising emails in Austria is subject to various legal provisions. On the one hand, the Telecommunications Act 2021 (TKG) specifies concrete requirements for permissibility, on the other hand, the GDPR must also be taken into account for the assessment. Section 174 (3) TKG therefore also stipulates that the sending of electronic advertising emails is not permitted without the prior consent of the recipient. This means that the advertising company may not send any emails with advertising content to the recipient without their express or implied consent.
Furthermore, we would like to point out that our e-mail addresses info@sonja-alpine.com and direktion@sonja-alpine.com are registered in the ECG list of RTR-GmbH (“Robinson list”). Sending e-mail advertisements to our company is therefore not permitted in any case and gives rise to reimbursement of costs for warning letters and injunctive relief. This applies to both domestic and foreign natural and legal persons.
Jurisdiction agreement:
If e-mail advertising is sent to our company by foreign natural or legal persons, the Austrian place of jurisdiction is established.
